Use of this Site and engagement of our Services is available only to individuals aged 18 and above with the legal capacity to enter into a binding agreement under Malaysian law. By submitting an enquiry or engaging our services, you represent that you meet this requirement.
Browsing this Site does not itself create a solicitor-client relationship. Such a relationship is established only upon our written confirmation of engagement.
3. Service Description
Cahaya provides family law advisory and representation services in Malaysia, including but not limited to:
- Confidential family consultations addressing civil and Syariah matters
- Representation in divorce, separation, custody, and ancillary relief proceedings
- Ongoing family counsel arrangements for clients with continuing needs
Our services are available in Penang and, where the matter permits, across Malaysia. The scope, fees, and terms of each engagement are confirmed in a written engagement letter. Information on this website is for general guidance only and does not constitute legal advice.
We reserve the right to decline any enquiry or engagement at our professional discretion, without being required to provide reasons.
4. User Responsibilities
When using this Site or engaging our Services, you agree to:

6. Payment Terms
Fees for our services are set out on this Site as indicative starting points and confirmed in each engagement letter. All fees are quoted in Malaysian Ringgit (RM).
- Consultation fees are payable in advance of the session
- Representation fees are structured as agreed in the engagement letter, typically with an initial payment upon confirmation
- The Continuing Family Counsel Programme fee is payable annually at the commencement of each programme year
Payment is accepted by bank transfer and such other methods as are indicated on your invoice. Receipts are issued upon clearance of funds.
Where a matter is discontinued at your request after work has commenced, fees for work performed to that point are payable in accordance with the engagement letter. We do not offer blanket refunds once professional services have been delivered.
7. Service-Specific Terms
7.1 Quiet Family Consultation
Consultations are scheduled by appointment and held in private. The written summary provided afterwards is for the client's personal use only. It does not constitute a legal opinion or advice in the formal sense and should not be shared or relied upon as such by third parties.
7.2 Divorce and Custody Representation
Representation begins upon receipt of the signed engagement letter and initial payment. The scope of our engagement is limited to what is specified in that letter. Changes to scope require written agreement. Timelines in proceedings are subject to court scheduling and the conduct of other parties, which are outside our control.
7.3 Continuing Family Counsel Programme
The programme operates on an annual basis. Unused consultation sessions do not carry forward to subsequent years. The programme may be renewed by mutual agreement at the end of each year. Standing representation within the programme is subject to the scope agreed at the outset.

10. Indemnification
You agree to indemnify and hold Cahaya, its lawyers, and staff harmless from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of this Site, or any inaccurate information you have provided to us, to the extent that such claim would not have arisen but for that breach or misuse.
11. Termination
You may discontinue use of this Site at any time. Termination of a professional engagement is governed by your engagement letter and the professional conduct rules of the Malaysian Bar.
We may withdraw your access to this Site or decline to continue an enquiry at our discretion, particularly where these Terms have been breached.
Provisions that by their nature should survive termination — including those relating to intellectual property, disclaimers, and limitation of liability — continue to apply.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising in connection with them is subject to the jurisdiction of the courts of Malaysia.
Where a dispute arises in connection with our professional services, we encourage clients to raise the matter with us directly in the first instance. We take client concerns seriously and seek to address them without recourse to formal proceedings where that is possible.
Clients who are dissatisfied with the handling of a complaint may refer the matter to the Malaysian Bar's Disciplinary Board in accordance with the Legal Profession Act 1976.
13. General Provisions
- Entire Agreement: These Terms, together with any engagement letter, constitute the entire agreement between you and Cahaya with respect to this Site and our Services.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any right under these Terms on a particular occasion does not constitute a waiver of that right.
- Assignment: You may not assign any rights or obligations under these Terms without our written consent.

14. Changes to Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Material changes will be communicated to clients with whom we have an active engagement.
